A company has been convicted and fined $212,500 after a worker was seriously injured by metal debris while working on a bucket elevator conveyor. SafeWork says controlling risks from moving plant and fixed machinery remains a regulatory priority.
The incident occurred on 13 February 2022 while the worker was carrying out work on a bucket elevator conveyor. The worker was struck by metal debris and suffered serious injuries.
The company pleaded guilty to failing to comply with its health and safety duty to workers under the Work Health and Safety Act 2011. The District Court of NSW imposed a $212,500 fine following the SafeWork prosecution.
SafeWork Commissioner Janet Schorer said risks associated with moving plant and fixed machinery are seen across industries and that established risk control measures are available.
SafeWork has identified preventing injuries caused by mobile plant, vehicles and fixed machinery as an area for action in its regulatory priorities. The regulator emphasised the importance of assessing risks and implementing safe systems of work when managing these hazards.
SafeWork also directs businesses and workers to its resources for managing risks associated with plant, machinery and equipment. The company has the right to appeal against its sentence.
